Police officer in court – 15-year-old killed by police car: trial starts

A police officer has to answer for the charge of negligent homicide at the court in Tamsweg on Wednesday. In November 2021, the officer followed a 15-year-old moped rider with the patrol car. He fell on a dirt road directly in front of the police vehicle, was run over despite emergency braking and was killed.

According to the expert, the collision would not have happened if the footrest of the moped had not caught in the ground.

The patrol had followed the moped with flashing lights and a siren because it had no lights and was apparently going too fast. When the teenager turned onto a dirt road in the Göriach Congregation, his speed caused him to fall.

Investigations initially suspended
The Public Prosecution Service initially stopped their investigation because they could not find any (gross) negligent behavior. However, the boy’s family was not satisfied with this and a senate of the Salzburg court ordered the proceedings to continue because, in his opinion, the distance to the moped rider was too small.

Victim lawyer Stefan Rieder said: “If the police hadn’t been chasing him, the boy wouldn’t have been driving so fast and wouldn’t have fallen.” The defender of the suspected police officer, on the other hand, spoke in advance of a succession of unfortunate circumstances, an unrecognizable violation of care.
