In the process of the motorsport accident, which injured eleven spectators at a racing event in Carinthia last August, a diversion was ruled on Friday by the Feldkirchen court.
The chairman of the club from St. Margarethen and the club MS Team Cockpit were charged. The chairman (66) had to answer for himself and the club for negligent bodily harm because there was an allegation that the venue was not properly secured.
Crashed in crowd due to driving error
Due to a driving error, a driver lost control of his vehicle during the competition in sports arena Falkert in the village of Patergassen in the municipality of Ebene Reichenau. He crashed into a group of people. In this area, logs should have prevented the car from breaking into the crowd of spectators. The spectators were held by logs, but there were none at the exact spot where the accident happened.
According to the chairman, nothing could have happened there, since the drivers had been urged to leave the area at a walking pace after the finish. “But the driver wanted to turn off a ‘Ringerl’ and then his car broke down. I know that something like this should not happen,” said the chairman before judge Irene Malle-de Cilla.
“It is just clear that the barrier was not in order,” the judge said when announcing the verdict. Both defendants, the association and its president, must pay a fine of 1528 euros and 1328 euros respectively, plus 1000 euros each for pain and suffering for the seriously injured and 300 euros for the slightly injured. The suspect claimed responsibility for the accident.
