A 15-year-old care pupil in Eisenstadt now had to answer to court for fraud. There was no verdict because the legal guardians did not appear.
Sandra (name has been changed) really hadn’t had it easy in her life so far. Due to serious problems in her parents’ house, the teenager lives in a children’s home. She is also mentally retarded and has only been in a special school for nine years so far. Nevertheless, the girl is able to distinguish right from wrong and now had to go to court for a “great stupidity”, as Sandra herself admits.
Girls went shopping with the loot
Together with two friends (both under 14 and therefore not criminally responsible) she was on a bus last summer. When a woman found a wallet and asked who it belonged to, Sandra said it was hers and took it – a lie and a criminal offence! Sandra went shopping with her friends. Damage: 190 euros.
Quickly found thanks to cameras
When the victim reported the crime, the surveillance camera footage made it easy for the police to track down the perpetrators. Judge Birgit Falb led the proceedings with a great deal of human empathy and yet with the necessary severity, with the girl’s parents – despite understanding – not even appearing. The caretaker of the 15-year-old from the children’s home was the only person she trusted to attend the trial.
Parents were not present at the trial
Mrs. Rat offered the confessing girl a diversion: if she pays the damage of 190 euros, the procedure will be stopped and Sandra will have no criminal record. The 15-year-old and her lawyer agreed in principle. But because in the case of minors, at least one legal guardian should have been present during the trial, the trial was postponed.
