An entrepreneur from the Vöcklaruck district had pasted the so-called Black Sun – a symbol of the extreme right scene – together with his company logo on his garage window. On Tuesday, he was sentenced to twelve months in prison in Wels for violating the Nazi prohibition law. The verdict is final.
A passer-by started the business in the autumn of 2021. Outraged that a large “black sun” was shining from a garage window in Wolfsegg am Hausruck, the woman turned against the Mauthausen Committee (MKÖ).
“The lady sent us a photo as proof that showed that the homeowner had even incorporated his company logo into the Nazi symbol,” says MKÖ spokesman Willi Mernyi. He filed a criminal complaint with the public prosecutor’s office of Wels under the Prohibition Act (§ 3g). The Office for the Protection of the Constitution took over the investigation.

At the time, the homeowner claimed to the ‘Krone’ that he had nothing to do with right-wing extremism ideologically. He didn’t know that the “Black Sun” was a forbidden sign – he just liked it. However, Nazi memorabilia such as mugs with Hitler pictures and belts with the Imperial eagle and swastika were later found in his premises. In the house there were also other foils with the “Black Sun”.

On Tuesday, the 52-year-old had to answer to the regional court of Wels for violating the NS prohibition law. At the hearing, however, the entrepreneur was able to credibly assure that the Nazi paraphernalia in the house were not publicly accessible. He was acquitted on these counts.
One year in prison
But a conviction for the black sun on the window followed: a year’s probation – final. Mernyi: “An important judgment that only became possible thanks to civil courage.”
