In seven weeks, the Supreme Court (OGH) will hear the pending appeals in the case of the deceased 13-year-old whose body was found lifeless by passers-by on June 26, 2021 on a green strip in Vienna-Donaustadt. A 24-year-old filed a nullity complaint and appeal, a 20-year criminal appeal.
OGH media spokesman Frederick Lendl confirmed this on request on Wednesday. A five-member Senate will therefore meet on May 31 in a public session day. Three men of Afghan descent took the girl, who lives in Lower Austria, to an apartment, gave the schoolgirl ecstasy and abused her when the drugs started to take effect.
According to the findings of the Vienna regional court, which are not legally binding, the 13-year-old died a violent death due to drug poisoning and suffocation. The three men were sentenced in first instance on December 2, 2022 as charged.
The 24-year-old main defendant was sentenced to life in prison for murder and rape. A co-defendant 19-year-old, who owned the apartment where the drama took place, received 20 years for negligent murder and rape, a 20-year-old for the same crime constellation 19 years.

With regard to the two men and the scope of their appeal, the decisions of the first instance are therefore not yet final. The 19-year-old, on the other hand, accepted the verdict of the regional court.
