Girl sexually abused since she was twelve: the lay judges in Eisenstadt believed the words of the victim and not the vague constructions of the now 61-year-old.
The abuse of power started in 2000. Anna (name has been changed) was then twelve years young. The then 38-year-old developed an increasingly intimate relationship with the neighbor’s daughter – during lunch he caressed her thighs unnoticed by the others, they exchanged French kisses, caressing and even sexual intercourse: in the nursery, at his workplace in the Vienna Regional court, in the car, in a hut, in the Neusiedler See.
“Just a Fatherly Friend”
“It’s not good,” said the man from northern Burgenland, who trembled and tried to answer before a lay judge in Eisenstadt. “She forced herself on me,” said the perpetrator, “she talked herself into a love relationship.” His lawyer even said, “It all came from her imagination. He was just a paternal friend.” And: “To prove that something didn’t happen is almost impossible.”
“Anna was already 16!”
The 61-year-old even admitted to having intercourse once. But then Anna was already 16. General: “Oral sex and using vibrators – no. I’ve never done that in my life. You can ask my ex-wives.” They dutifully testified and supported him. Admittedly, neither of them had ever noticed the goings on. He was simply lovingly caring for Anna, otherwise she would have no contact!
They also did not know about the messages he wrote, such as “Hello Mauserl, your raccoon loves you”. Why did Anna’s school friends know that “her older friend was circumcised”? “I have no idea where they got that from.”
Some 21 years after the first attack, 34-year-old Anna found the courage to report the tormentor. Now the “raccoon” must pay for his actions: three years in prison for serious sexual abuse of minors, 10,000 euros in compensation. Time to think!
