The shock after the fatal accident during a swimming trip in Burgenland is still deep. While the 38-year-old father was smoking on the outside area of the Sonnentherme in Burgenland, his daughter Dunja (5) drowned in the river basin – the Viennese must now answer to the court.
“My client is deeply broken and will never be able to forgive himself for this mistake,” says lawyer Manfred Arbacher-Stöger. He represents Dunja’s father. The five-year-old drowned in the Sonnentherme Lutzmannsburg on March 4 after jumping into the current pool.
“Wait Here When I Come Back”
The Viennese will soon have to answer to the judge there. The charge is grossly negligent homicide – the man faces up to three years in prison. The 38-year-old went out for a smoke with his companion and left his two daughters alone on the spot near the 1.9-meter-deep pool. “Wait here, when I get back we’re going for a swim,” he allegedly said.
According to the complaint, Dunja’s father spent more than 20 minutes in the thermal bath restaurant and outdoor area, even though he knew his daughter could not swim. In those minutes, disaster struck: the girl jumped into the water unattended. He and his companion had not seen Dunija jump into the water.
A few minutes later a visitor pulled Dunija out of the water, a helper alerted the lifeguard and the rescue chain was on its way. However, all help came too late for the girl.
According to acquaintances, the man, who works in the public sector, is a loving father who did something with his girls every weekend and lovingly cared for them. The suspect lives separately from Dunja’s grieving mother.
Investigations against lifeguards halted
However, the investigations against the lifeguard on duty and a person responsible for the thermal baths were stopped. You have not breached your duty of care.
