Wants 100,000 euros – wrongly deported student is suing Republic

A 16-year-old Nigerian who was wrongfully deported is now demanding 100,000 euros in damages from the Republic because she lost two years of work. The young woman lived legally in Austria, her mother worked at the Nigerian embassy. She, her twin sister and her 14-year-old brother applied for a student visa in February 2018. The mother terminated her employment at the embassy.

The law provides that asylum seekers may await the final outcome of such a residence procedure in Germany. In this case, however, the immigration police acted immediately and quickly deported the family to Nigeria, as reported in the current issue of “Falter”.

Federal Administrative Court agreed with teens
In Africa, the woman found out that she had become pregnant – from her Austrian boyfriend. She and her siblings filed a complaint against the deportation. The judge at the Federal Administrative Court (BVwG) not only agreed with her, but also reprimanded the Federal Office for Asylum and Immigration. “For the judge who made the decision, no facts emerged from the reasoning of the concerned authority that would even begin (the eviction, note).”

On the contrary: “On the whole, it is striking that the complainants are innocent, that there are three children whose proceedings (…) have not yet been decided, and that the children appear to have been integrated into Austrian society on the basis of the state of the files.”

Student’s lawyer demands 100,000 euros
Just a few months later, in September 2019, the young woman returned to Austria on a student visa. The schoolgirl gave birth to her child in Vienna, her siblings later followed. Her lawyer is now demanding around 100,000 euros from the Republic. According to the lawyer, the children in Nigeria had to bear high costs for housing, tutoring, computers and furniture.

But above all, they lost two school years because they were expelled from school, argues the lawyer for those affected. No more was allowed inside. The young woman is now taking her evening school final exams, but the start of her studies and with it her career (she wants to become a pharmacist) has been delayed by two years. Your loss of income as an employee in two years: about 70,000 euros.
