According to the judge, the decision of the Azpeitia municipal council is “not in accordance with the law”. Mayor Nagore Alkorta has confirmed that they will appeal the sentence.
The contested Administrative Court Number 1 of San Sebastián annulled the court’s decree Azpeitia Town Hall which prevented the Cristian Ley Corrugados business group from reopening in its current location in the said city of Guipuzco, in the city center. The municipal decree, issued in September 2021, declared the expiration of the Extremadura group’s activity permits, so it did not take long to appeal the decision.
In the ruling, the judge said that the decision to oppose the resumption of activities in the city center was “not in accordance with the law” because it meant that the activity permit “expired earlier”.
Mayor Nagore Alkorta has confirmed to the EITB that they will appeal against the sentence.
Corrugados Azpeitia, owned by the Gallardo group, closed its doors in 2013, when it had 300 employees. In 2020, the Cristian Lay company took over the group and announced its intention to reopen the Guipuzcoan factory. Both the Basque government and the Gipuzkoa provincial council were in favor of this opening.
As she defended when the controversy broke out, the mayor of the municipality stated yesterday in the plenary meeting that the municipal council “never had a project on the table” for CL and that all decisions were taken “within the legal and not within the political framework. ”
