After regular abuse at home, a woman from the south of Burgenland has now been beaten with a gag in court. During the trial in Eisenstadt, her husband’s statements were believed: “She fell down the stairs several times on her own initiative.”
Violence against women is constantly increasing. There have already been 25 femicides in Austria this year, plus 40 attempted murders. Politicians and police are urging women exposed to domestic violence to seek help.
That’s what a woman from the south of Burgenland did. She turned to the Violence Protection Center and filed a complaint against her estranged husband after years of protecting him with her silence. In July the man, who had two previous convictions, was taken into custody.
The 40-year-old did everything right and is still a loser.
“I never hit her!”
During the trial in Eisenstadt, the 41-year-old stated that his wife had “fallen down the stairs several times on her own initiative”; that she had a cut in the kitchen cupboard; fell over in the garden, ran into the door or fell out of the moving electric tricycle. “I never hit her!” says the suspect. “She drank so much that I had to tell her the next day where she got the bruises.”
Crying, the woman reports abuse and talks weekly about unwarranted staggering, about regular bumps, pushes and kicks. Of broken toes and ribs, of concussions and swollen eyes. In 2023 alone, eight incidents were documented, three of which, according to a court-certified expert, could exclude personal negligence. His report states: “These injuries, due to their location, cannot be explained by a simple fall to the ground, but rather by punches and kicks.”
“Actually not incredible”
The woman was in principle not unreliable, the judge said, before he acquitted the man out of doubt. He had been released. The Public Prosecution Service has until Monday to appeal.
Speaking of credible: did the 41-year-old actually falsify findings? To determine that he had given up alcohol, the convict had to submit his liver values to the judge every month. These did not correspond to the actual ones, which were far too high. He is therefore said to have violated the terms of his probation: 31 months of suspended prison sentence are still outstanding. But: this does not belong in this procedure, it was said.
It is the presumption of innocence.
