As regards the duration and costs of the divorce, a fundamental distinction must be made between a divorce based on fault (Article 49 of the Marriage Act), a divorce by consent (Article 55a of the Marriage Act) and a divorce resulting from of the abolition of domestic intercourse for three or six years (Article 55 of the Marriage Act).
“Many clients believe that there is no longer a fault-based divorce in Austria,” says lawyer Maria Christina Kolar-Syrmas, “that is actually not the case.”
