A few days after the birth of his daughter, a 31-year-old in Vienna clicked the handcuffs. The story is hard to believe: the very man who nearly stabbed him to death in 2023 falsely accused the new father of drug dealing while he was in prison. The Linz public prosecutor believed him.
Tears of joy are rare in court. They streamed in front of room 32 in the Wiener Landl on Friday. After the acquittal, the defendant hugs his wife and two-month-old daughter. The woman and the little one were released from the hospital three days after the baby was born. At the same time, the handcuffs clicked out of nowhere in Vienna-Meidling.
Torturous weeks in custody followed and the indictment by the Linz Public Prosecutor’s Office was a pure nightmare for the suspect. What the 31-year-old, who committed a crime in Germany many years ago, is charged with is based solely on the testimony of his childhood friend.
Ex-boyfriend falsely accused out of jealousy
“The man imagined that my client was having an affair with his wife,” lawyer Philipp Wolm said in his plea. The dispute culminated in January 2023 when the Albanian stabbed the now suspect. The ‘friend’ had to stand trial for attempted murder and was sentenced to ten years in prison.
On Friday, the menacing-looking man from Stein prison will be brought in to testify as a witness to substantiate the allegations against his former victim. Accordingly, the young father gave him four kilos of cocaine. He sold half of it and consumed the rest himself. ‘I didn’t give him anything. I think he says it because he is jealous that I have a nice family life,” the suspect said desperately during the trial.
First months of life without a father
“There is no evidence whatsoever, only the perpetrator’s claims at the time. Anything other than an apology because he was innocently in custody, and an acquittal would not be worthy of the rule of law,” says Wolm. When judge Peter Sampt pronounces this, the defendant folds his hands in relief. He storms out of the hallway to his wife and daughter – who had to spend the first two months of her life without her father. The small compensation cannot replace this time.
