The Bosnian defendant (21) in the leather jacket slowly and slowly answers the questions of judge Thomas Tovilo-Moik: “I am partly guilty. But I certainly did not drive 120, I was not that fast,” he explained in the regional court on Thursday about the charge of murder by gross negligence. He feels guilty because someone was injured and because someone died. The person who died in the accident was a friend, a 19-year-old Syrian, and the injured person, a friend of the same age.
On that fateful August 6, 2022, the three of them were in the Audi A6, which the suspect, then only 19 years old, had borrowed from his father. It was around 10.30pm on the B311 near Saalfelden, heavy rain. During the test, aquaplaning was discussed.
The assessor emphasized that the speed was too high
“Do you think you made a mistake?” asks the judge. The innocent student responds with longer pauses, “Yes, I should have driven less than 80.” He only got his driver’s license a few months ago and had not yet completed driving safety training: “I didn’t know how to react to aquaplaning.” That girl, who was in the car at the time of the accident, said as a witness: “I just didn’t see anything and then I woke up in the hospital.” The expert Gerhard Kronreif made it clear: the driver had at least 120 on the speedometer when it happened – so he was about 50 km / h too fast.
The verdict, which was not legally binding, was a probation period of six months and a fine of 5,400 euros. And victim advocate Stefan Rieder was awarded 60,000 euros for the surviving relatives.
