In a sensitive case against a Tyrolean, the public prosecutor appealed against an original diversion without punishment. Now the 72-year-old has to pay because the judge did not believe his excuses in the second round of the trial.
The charges were the same as in the first round of the trial in November: the 72-year-old allegedly demanded photos of the family nanny in her underwear, otherwise he wanted to intervene with the AMS and have her visa blocked. “She was just part of the family, I was worried,” he said, justifying his controlling behavior. The au pair from Madagascar sometimes did not come home for days or was not available.
Instead of an earlier confession, now a different version
Little was left of the admission in November that he had sent suggestive or at least transgressive WhatsApp messages. “I didn’t do anything,” he said several times.
According to the suspect, it went like this: “The babysitter sent the suspect messages to himself, from our family phone.” She had the PIN code for this and the suspect’s wife provided support as a witness. His wife vehemently denied that her husband could be interested in the girl. “It was a completely normal working relationship,” she said.
Reason for alleged ‘revenge’ questionable
Judge Norbert Hofer had doubts and asked several times why the au pair should have done that. “Out of revenge,” said the Tyrolean couple. His wife allegedly forbade her from going to Berlin. “Then she and her boyfriend just made up the story to me,” the 72-year-old claimed.
Judge Hofer did not believe this story. “What’s the point of that?” he asked several times. The public prosecutor argued the same in his closing argument. But the defendant stuck to his new version of the story. He wants to appeal against the verdict – an unconditional fine of 6,000 euros.
