The verdict has been delivered: AfD may be a suspected right-wing extremist case

The German Federal Office for the Protection of the Constitution can continue to classify the AfD as a suspect case following a decision by the Higher Administrative Court (OVG) in Münster.

On Monday, the court rejected an appeal by the AfD against a ruling by the lower court in Cologne.

The Office for the Protection of the Constitution upheld proportionality in its measures, the court explained in its ruling. The verdict is not yet legally binding.

The OVG did not honor an appeal. However, the AfD can file a complaint with the Federal Administrative Court in Leipzig.

“Unacceptable discrimination”
The powers of the Office for the Protection of the Constitution are “by no means unlimited,” but a well-strengthened democracy cannot be a “toothless tiger,” 5th Senate President Gerald Buck emphasized in the justification for the decision. The Senate is convinced that there is a well-founded suspicion “that it is in line with the political objectives of at least a significant part of the AfD to grant only German citizens with a migration background a legally devalued status.” According to the constitution, this is “inadmissible discrimination”.

The procedure is compatible with the Basic Law, European law and international law.

The verdict comes in the middle of the campaign for the European elections in early June and in the preparations for the state elections in Brandenburg, Thuringia and Saxony. According to studies, the AfD is especially strong in the eastern German states.
