The Unterländer was sentenced last year to 3.5 years in prison for exploiting the homepage. According to the public prosecutor, he was unable to take the homepage offline after the ruling and the decision.
“Forgot your password”
The 56-year-old man pleaded not guilty during the trial. He “forgot” the password for the homepage where he has been publishing relevant Nazi content for years and therefore “could not delete this page at all.” This line of argument was also previously followed by his lawyer, who also pointed out that he would not have been able to take such steps from prison, or would have found it very difficult.
In addition, she legally believes that you cannot be convicted multiple times for the same offense – in this case the homepage with extremely relevant Nazi content. However, the submitted statements – which could possibly have led to the man’s acquittal – were rejected.
Failure to do so led to ‘Nazi advertising’
The prosecutor argued very differently from the lawyer. By not deleting the data, the man was again involved in National Socialist activities and should therefore be found guilty again. “The omission and the content of the homepage are absolutely sufficient to advertise the Nazi era, so to speak.”
Final judgment not yet
The jury ultimately followed the prosecutor’s approach and voted seven yeses and one no for the man’s guilt. The receipt carries a four-year prison sentence. So now he is serving more than seven years in prison. The judgment is not final.
