A 45-year-old man was sentenced to 7.5 years in prison by the Vienna Regional Criminal Court on Thursday for fatally pushing an acquaintance in January.
The Salzburg native actually only wanted to settle a dispute at the Praterstern. According to him, one of the troublemakers approached him in a threatening manner and therefore gave the 61-year-old a push. The man fell, hit his head and suffered fatal traumatic brain injury.
Suspected concussion
The man was initially admitted on suspicion of concussion. However, the injuries turned out to be much more serious. The 61-year-old died after a week in the hospital. The 45-year-old pleaded not guilty. He actually wanted to meet a friend in Praterstern on January 8 who still owed him money.
The 45-year-old had often stayed at the train station in the past, but wanted to start a new life after his release from prison. “There are always so many arguments there.” But he knew most of the people at Praterstern. The 45-year-old was still shopping in a supermarket when he saw his 61-year-old friend arguing with a woman about a stolen wallet.
“Leave him alone”
The woman hit the man twice. When the 61-year-old then insulted another man he also knew, he intervened. “Leave him alone, he didn’t do anything,” the 45-year-old told the argumentative figure. The 61-year-old then came over, pushed his chest against the younger man’s and raised his fist to strike.
“Unfortunately I didn’t take it seriously”
The 45-year-old pushed him away, the 61-year-old took a few steps back and collapsed. “I thought he was going to let himself go. “He’s said before that he’s going to make someone pay for the pain and suffering,” the defendant told the jury. “Unfortunately, I didn’t take it seriously and walked away. “I didn’t think he was going to fall and hurt himself, let alone die,” the defendant said.
“I regret being there at all and getting involved.” The verdict for bodily harm resulting in death is already legally binding.
