The “Krone” reported: The Federal Administrative Court has ordered the return of Maria G. together with her two children. The woman from Hallein joined ‘IS’ in 2014 and traveled to Syria to do so. If she returns, she will face criminal charges under the Terrorism Act.
Maria G. from Hallein was radicalized at a young age. At the age of 17, she cut all ties and traveled to Syria to join the so-called “Islamic State.” That was ten years ago. She was on the Federal Criminal Investigation Department’s wanted list for a long time because she was suspected of supporting a terrorist organization.
The Ministry of Foreign Affairs therefore refused for a long time to return the woman. The federal government only wanted to retrieve the two children born from the marriage to an IS terrorist.
But neither the family nor Maria G. herself wanted that – if so, then only together. G. and his sons have been in an internment camp in northern Syria for years.
The ministry could challenge the decision
Now there is a new development thanks to a decision of the Federal Administrative Court: it ordered the joint repatriation. Lawyer Doris Hawelka explains: “Since the woman is imprisoned, she cannot return alone. That is why the federal government has a legal obligation to assist and recover.”
She is also aware that if she returns, she will have to go to criminal court; criminal proceedings against her are still ongoing. “She is aware of it and will face it,” Hawelka emphasizes. The parents are “delighted” after years of struggle.
But: Refunds are only possible once the decision has become legally binding. And the State Department can still appeal and take the case to the highest court
