Just on Saturday we reported on the case of a young man from Graz who was asked to pay 250 euros for three minutes in a private parking space. Because he was a student, he was able to get a 50 percent discount. A woman from Deutschlandsberg was less “lucky”.
She recently received a letter from a lawyer that left her speechless. At the end of September, she parked her car for a few minutes in a company parking lot opposite a fast-food restaurant in the district capital. Even faster than the food next door, the photographic evidence was prepared and things took their course.
Short stop in a deserted parking lot
The driver didn’t even park, as evidenced by the surveillance camera footage, but merely parked the vehicle sideways in the nearly empty parking lot for two minutes.
The owner of the parking lot is a storage technology and racking systems company that advertises itself with the slogan “For the sake of order”. She saw that good order had been disturbed and a local law firm was called in.
Ten days’ notice, otherwise lawsuit for property interference
A few days later, the short-term parker read in a letter (see below) that she had ‘disturbed the peace and quiet of my client’s property’. She must refrain from “such acts of property interference” in the future and must pay “an amount of € 290.00”. The payment term is less than the requested amount: ten days.
As is almost “good form” in such cases, “without further correspondence” there is a threat of a claim for interference with possession if the payment and charge statement are not repaid on time. Keyword: good manners: The lady had to ‘apologize’ in writing and promise ‘not to engage in such behavior in the future’.
As reported, something similar happened in October to a student from Graz, who had to pay 250 euros – also for a few minutes of illegal parking. By referring to his income situation, he was able to halve the amount in a telephone conversation with the other party.
Objection is hopeless
After asking her lawyer, the woman from Deutschlandsberg decided to abandon such an attempt: it was hopeless, the expert decided soberly.
