Peter F. is angry. In 2020, he personally called the municipal office in Pfaffstätten, Baden district, asking if he could build a small wooden hut on his forest land. He was verbally promised this, on the grounds that no permission was required for a small material shed of less than ten square meters.
Three years later: News comes from the community and the BH that this hut is to be demolished again (see facsimile above). F. has applied for a follow-up building permit. The rejection followed: ‘Because our site is now suddenly considered a grassland-free area,’ F. explains. “Now it’s no longer about the hut for me, it’s just about justice.”
Other buildings in the area have undergone massive expansion in recent years. When asked by the mayor, he referred only to the amnesty booth ordinance, which was in force until 1999. This states that existing huts may be renovated, but not enlarged, to protect them from demolition.
Mayor Christoph Kainz: “Due to a complaint against Mr. F.’s building, the building authority had to take action.” Nothing is known about an oral request in 2020. And: “There are currently various demolition procedures underway; We cannot provide further details due to the ongoing procedures,” the mayor said.
