Clear Legal Framework – Tuscany approves a 1st region of the death of euthanasia

Date:

Tuscany has passed a law on the right to euthanasia and is therefore the first region in Catholic Italy that regulates euthanasia in the absence of a national law on this controversial subject.

The regional law of Tuscany, which was adopted by a majority of 27 to 13 votes, determines how applications should be treated on suicide help.

A medical body in the region is obliged to check the applications within 30 days. If the criteria are met, the regional health service must offer the necessary medication and medical staff within ten days, unless the patient wants his own doctor to carry out the intervention.

Italian public health care is regionally structured
The law enables doctors to refuse moral reasons to participate in the procedure – comparable to how national legislation on the abortion of pregnancy for such – driven refusers has already been made cumbersome for reasons of conscience. Public Healthcare in Italy is largely structured on a regional basis. Italy is divided into 20 regions.

The Italian Constitutional Court had de facto legalized the 2019 procedure and asked the parliament to take a law to create a clear legal framework. However, the request was not followed because the national politicians avoid the subject and have not yet said goodbye to the subject.

Constitutional Court already gave the green light in 2019
Before the approval of the Tuscany law, the conservative Catholic philosophy of life “Pro Vita Famiglia” criticized that the region turns into a sort of “Italian Switzerland” in which “State Dood is performed to get lost, vulnerable, old, old, old , and lonely people “. Assisted suicide has been allowed in Switzerland since the 1940s.

The Tuscany is ruled by Center-left parties, but at national level the right-wing coalition of Prime Minister Giorgia Meloni is largely against euthanasia. In 2019, the Italian constitutional court allowed euthanasia for patients suffering from incurable diseases who cause “unbearable” and who express clear deaths.

Nevertheless, the regional health authorities still hesitate to approve of requests for euthanasia, so that the Pro-Uthanasia Association “Luca Coscioni” has made a campaign for clearer legislation on this question. The association has largely inspired the law approved by Tuscany.
