Return arranged – accidentally deported to the US

In the dispute about the accidental deportation of a man in a notorious prison in El Salvador, the US government suffered a legal defeat. A federal judge in the state of Maryland ordered that Kilmar Abrego Garcia, who comes from El Salvador, the moment it had to be returned to the US on Monday. The Ministry of Justice immediately appealed.

The family man belongs to a group of migrants who have recently been brought from the US to the Salvadorian high-protection prisoner of Cecot-Vinde contrary to an order of another judge in the American capital Washington.

Protected against deportation
According to the American media, Garcia entered the US in 2012. Although his asylum application was rejected in 2019, the competent court asked him to protect deportation at the time – with regard to imminent prosecution in El Salvador. Nevertheless, he was arrested in Maryland on 12 March and deported a few days later. Judge Paula Xinis now assessed this as illegal.

The deportee’s wife said in an interview that she was afraid of his life because he was held in prison with high security with some of the most dangerous criminals in the country.

In this case, the government of US President Donald Trump has granted an “administrative error” but states that Garcia is a member of the Bende MS-13. She also explained that return was not possible because Garcia was in the detention of another state. However, according to the American media, a government lawyer admitted that a withdrawal was fundamentally feasible.

Judge: “In my opinion only Chatter”
According to the reports, Xinis was skeptical about the allegations against Garcia. In her opinion there is no reliable proof of gang membership. The judge quoted “polico” with the words: “In my opinion this is only a chat.” If someone is suspected of a gang membership, this must be clarified in a regular criminal procedure. Accordingly, a government representative also admitted that Garcia should not have been deported.

In the current debate about the deportations to prison, the White House refuses more information about the specific allegations against the affectors. It is generally only about memberships in the criminal gangs the Aragua from Venezuela and MS-13 from El Salvador-Both were declared foreign terrorist organizations under the government of Trump.

As a legal basis, the government from the 18th century refers to a controversial war law. Legal tugboat of war on whether this is legal is now working on the Supreme Court.

Profitable deal for El Salvador
