Damage to 108,000 euros – despite eight months in prison, politician remains in office

Due to unfaithfulness and damage of 108,000 euros, an FPö councilor from the Linz country (Upper Austria) district was legally sentenced to a conditional prison sentence of eight months. Nevertheless, she held her place in the local parliament. From a legal point of view, the behavior is legitimate, but very doubtful for many.

An FPö councilor of the Linz-Land district legally compensated eight months in prison and a fine of 10,080 euros. As manager of a homeowner community, she had a loan of 105,000 euros and then transferred the money to six tranches – divided into one year – to her private account.

Even three years after her conviction for unfaithfulness and the total damage of 108,000 euros, the politician is still in the city council. This is permitted by law. According to the law, it should only withdraw from a one -year prison sentence. The politician may have flourished this amount of punishment if she had not repaid 85,000 euros in the course of the legal proceedings.

Party leadership not informed
“Generating damage is a reason for militation,” said Christina Formstner of the regional court of Steyrr. That is why the conviction was probably only very small circles. Neither the blue district nor the state party was known until Thursday. “I have not heard of it at all. We will look at this and advise you on the consequences,” says the district party leader of the FPö, Christian Partoll.

As a chosen mandate, the woman cannot be forced to resign. She should go voluntarily. The VP mayor of the affected community also only learned on Thursday about the machinations of the Freedom City Council. “She is also a rather inconspicuous politician. She must still be aware of her function of the role model,” the local chef said. Similarly, the Green State Parliamentary member Anne-Sophie Bauer sees it: “With this behavior you never strengthen confidence in politics.”
