Young people caught smoking cigarettes can be imposed as a punishment for social lessons. That is “not forced labor”. The Constitutional Court now comes to this interesting judgment.
Is it good to punish a young person who was caught smoking with ten social hours in a charity? And should the Styrian Youth Protection Act be changed? The Constitutional Court now had to decide this.
And the VFGH came to the conclusion: it is not in contradiction with the prohibition of forced or compulsory activities, young people who violate youth protection regulations to commit themselves to social benefits if they are considerably limited in terms of content and time. This is a suitable alternative to fines.
17-year-old caught smoking
In the specific case, the Deutschlandsberg district administration imposed an administrative fine of ten hours of social services on the Red Cross through a 17-year-old. She had smoked a cigarette in the Deutschlandsberg shopping center and therefore violated the ban on smoking for young people.
