Unions face Twitter over Spain layoff process

UGT warns that the adjustment proposed by Elon Musk would be null and void in our country because it does not meet the standard that regulates collective redundancies

The significant downsizing on Twitter that Elon Musk implemented last Friday arrives in Spain. As reported by CC OO and UGT, up to 26 employees of Twitter Spain have already received the controversial email in their personal accounts through which the company communicated the layoffs to those affected.

“It seems that yesterday at 5.30 pm almost all employees of Twitter Spain received an email with their resignation,” the general secretary of the organization, Unai Sordo, published this Saturday on his account on this social network.

Although it is a small office compared to the offices in other countries – with a number of employees in their 30s – the unions were willing to fight the company’s decision in legal proceedings, as these layoffs would be null and void because they are not carried out according to the collective redundancy formula.

The general secretary of UGT, Pepe Álvarez, explained via his Twitter account that national regulations also require the company to open a consultation period, negotiate for 15 days and communicate its decision to the labor authority. “If we don’t do it this way, the layoffs will be invalid and they will have to reinstate all employees,” he says.

Álvarez took the opportunity to recall “the need to recover prior administrative authorization in collective redundancies”, which was still pending at the time of the last reform. “Obviously we have to get back to it. People can’t be that unprotected,” he insisted.

They assure the unions that they will announce these layoffs to the Labor Inspectorate, and make themselves available to the workers to take any kind of legal action if they find it.

At the moment, the confusion is definitely among the affected workers. The exact number of layoffs has not even been confirmed, even at the Spanish headquarters, apart from the information processed by the unions. In addition, the fact that the company closed all its offices on Thursday “to ensure the safety of every employee” also did not exactly contribute to the transparency of the process.

However, according to Elon Musk’s plans, the cut would total about 3,700 employees worldwide, practically half of the workforce. The richest man in the world justified this decision by the losses of the social network, which he himself estimates at about 4 million dollars a day.

The businessman’s goal is to end the drop in income that will, predictably, worsen after several major advertisers have decided to withdraw their ad investment in the social network. Companies like Volkswagen, General Motors or the food giant General Mills have expressed concern about the drift of the social network with Elon Musk at the helm, especially because of the impact it could have on content management.

Added to this is the increase in the costs that the company will have to bear for the payment of the compensation and in light of the foreseeable legal battle that will arise from the employees. Of the company, they defend that, in the case of the US, Elon Musk has offered compensation for three payrolls that, as they explain, is 50% more than what is legally required in the country.

However, a class action lawsuit has already been filed in the San Francisco General Court as some of those involved believe the company broke the law by failing to give 60 days’ notice of this mass layoff.
