The Prosecutor’s Office does not agree with the statement of Supreme Court Justice Pablo Llarena, as he believes that despite the withdrawal of sedition, the penal reform allows attributable to the former president of the Generalitat Carlo Puigdemont the crime of aggravated public disorder, in addition to embezzlement in its most serious form.
The prosecution has appealed the order in which judge Llarena removed the crime of sedition from Puigdemont and prosecuted him for disobedience and embezzlement, requesting that the crime of aggravated public disorder be included in the arrest warrants and imprisonment of former president of the Generalitat and former ministers Toni Comin and Clara Ponsati.
However, he is not asking for the same change for also former director Lluis Puig or for ERC general secretary Marta Rovira.
Prosecutors Javier Zaragoza, Consuelo Madrigal, Fidel Cadena and Jaime Moreno explain that they only disagree with the “process” instructor in his assessment of the criminal acts previously classified as sedition. The Supreme Court Prosecutor interprets that “the facts constitute a crime of public disorder because all the typical elements of article 557.2 CP are met: group action, to threaten public peace, non-compliance with court decisions and performance of typical acts of violence , harassment, obstruction of public roads at personal risk or invasion of buildings that alter their essential services”.
The crimes of embezzlement in the most serious form and aggravated public disorder can carry a maximum prison sentence of 17 years.
