The Democratic Memory Act of 2022 does not require the demolition of the listed building ensemble, so the cataloging standards of the Municipal Plan remain in force and therefore any intervention will require a process of amending these regulations, with a mandatory and binding report from the Prince of Viana Institute and, if applicable, approval in plenary.

This is the conclusion reached by the Pamplona City Council through legal advice, as reported in a statement explaining that the report was prepared after: mid-Octobersome memorial associations will insist on starting the administrative procedure for the demolition of the monument.

In their request, they argued that the repealing provision of the Democratic Memory Act had left the monument out of planning by suddenly canceling its protection rules.

For the associations, with their character as a Franco symbol and once outside the regulations, demolition was the only possible action by the municipal council against the complex, an argument rejected by the municipal legal services.

The municipal report explains this State law does not preclude Navarrese regulationswhich would actually be the reference to the case, but still, the report says, the Democratic Memory Act “does not force the Pamplona City Council to demolish the Fallen building”.

The monument is part of the Census of Franco symbols. In 2016, the government of Navarre accepted the recommendations of the Technical Coordinating Committee for Historical Memory for the entire census for the removal of symbols.

The current report highlights that of the Standard from 2003 and by analogy, from the rest, “the obligation does not arise that all buildings and monuments constructed during the Franco regime with the primary or secondary purpose of glorifying that regime should be demolished.”

Its wording, he points out, “assumes that the buildings remain standing and that only the symbols need to be removed.” And where necessary, deposited with the Príncipe de Viana Institute for conservation if they have historical-artistic interest.
