The Abuse Victims’ Commission has recognized 46 cases in the past year

Of the rights violations, most have been recognized for torture or serious ill-treatment, in 28 of them, although there is also recognition for death and serious injury. The Commission attributes most of the violations to the Guardia Civil and the National Police.

The Valuation Committee created on the basis of the Act of Recognition of Victims of Political Motivation recognized in the past year 46 victims of human rights violations

In an appearance today in the Basque Parliament, within the framework of the Commission for Human Rights, Equality and Justice, the above-mentioned committee presented the annual report, which corresponds to all its activities between June 2021 and this year.

All in all, the committee resolved 573 filesof cases that have been admitted for treatment, and has impermissible 523473 have been raised by members of the State Security Corps and Forces and 50 by people who have been victims of politically motivated violence by ETA or elements of their environment (this law does not consider this).

Of the rights violations, most have been recognized for torture or serious ill-treatment, in 28 of them. Behind them are six deaths, five cases of gunshot wounds, four cases of injuries with a rubber ball, two cases of serious injuries from aggression and one for violation of moral-psychological integrity.

The committee attributes the violations to: Guardia Civil (18), National Police (15)to the two bodies in different detentions (4) and to the Ertzaintza, A case. Likewise, it has been shown as proven that one of them was performed by: new powertwo for the group Triple Atwo more to Spanish Basque Battalion (ATE-BVE), an on Guerrillas of Christ the King and 2 remain unspecified.

Also the great most infringements took place in the 1970swith 28 cases, they have recognized nine cases in the past decade, eight between 1981 and 1990 and, the most recent, in 1997, with one case.

In some cases, the committee notes in its report, relatives are also victims of attacks on family homes or businesses, and abuses during arrests, but these cases are not counted.

“In most cases, the attitude of the institutions was collaborative, although it was not always possible to obtain the information requested, in some cases due to the long elapsed time and in other cases due to a lack of fluidity or clarity in the response to the request made. We note as particularly intrusive the attitude of the military archives of which we have not been able to obtain documentation of the requests made so far,” the committee denounced.

For example, the group’s members have “called for the cooperation of all entities as time is running out against many of the applicants.”

Commission recommendations and requests

The Commission believes that it is urgent to make the necessary legal changes to compensate for the “deficiencies in the law on reimbursements”. Today, according to what they have denounced, there are “clear injustices in cases of very serious human rights violations which, either they cannot be compensated, or require a ridiculous fee, name unworthy.”

In particular, the group asks “to remove the impossibility of compensation in cases of assault and torture and to enrich and make more flexible the possibilities of compensation in cases of injuries, whether permanent or not”.

The Commission of the Basque Parliament has also placed special emphasis, as in other reports, on the importance “of the symbolic value of the repair measures and the ensuing consequences for the right to truth and construction of collective memory
