Dupont, the famous lawyer of the ‘Bosman case’: “The ‘Diarra ruling’ is a total victory”

Date:

The Belgian jurist Jean-Louis Dupontyou, attorney of ‘Bosman case’ that changed European football in the nineties, ensured that the decision issued today by the Court of Justice of the European Union (CJEU) against FIFA and in favor of his client and former soccer player Lassana Diarra “paving the way to modernize football management.”

The CJEU pointed out this Friday that some FIFA rules on the transfer of football players are contrary to European law, because they prevent free movement and prevent competition between clubs and seem unnecessary or unnecessary.

In particular, it refers to the payment of compensation by the new club of the footballer, when his previous contract is unilaterally terminated, as well as the imposition of penalties for non-compliance with this rule and the possibility of the federations rejecting the certificate of transfer during the suit. lasts

The court made a decision this Friday regarding the case involving the Frenchman, Lassana Diarra, former player of Chelsea, Arsenal, Real Madrid and Paris Saint-Germain, among others, which challenged part of the regulations applicable to the contractual relationship between players and clubs of FIFA’s Regulations on the Status and Transfer of Players (RETJ).

“Following the decisions of the European Super League and Royal Antwerp FF (…), the CJEU, once again, severely punishes the structurally illegal actions of the current football regulators, thus paving the way for in modernizing its management,” he said. dupont in a statement on a first sentence assessment known this Friday.

The jurist, whose Dupont-Hissel office is also involved in the aforementioned cases, refers to the decision of December 2023 in which the CJEU considered that FIFA and UEFA are the rules on the pre-authorization of competitions in football clubs violate Union Law.

The EU’s highest administrative body then pointed out that UEFA and FIFA had abused their “dominant position” in their action against the creation of the controversial soccer Super League.

Regarding the other decision cited by the lawyer, also in December of last year, the highest administrative instance of the European Union, the CJEU considered that the rules of UEFA and the Belgian football association requiring the inclusion of a minimum number of young players in the lineup. may violate European rules on competition and free movement of workers.

Dupont considered Friday’s new decision to represent a “total victory” for his client, who has been fighting a legal battle for “ten years” and which has already been ruled in favor by the Belgian courts because “the FIFA and its members cannot now pretend they are surprised by the CJEU’s ruling.

“All players affected by these illegal rules (which have been in place since 2001) can now get full compensation for their injuries,” added the lawyer.

Dupont added that his firm specializing in sports law in the European Union is now confident that the decision will “finally force FIFA to submit to the rule of EU law and accelerate the modernization of governance.”
