According to a ruling by the highest court, the Netherlands must initially admit unlimited family members of recognized refugees. The highest administrative court, the Council of State, ruled in favor of international law on family reunification in The Hague on Thursday. The interests of the families must be valued above the interests of the state. It is already the fourth verdict against the controversial curtailment of the right to family reunification.
Since the autumn, family members of refugees with a residence status will only receive a visa for the Netherlands after 15 months or only if they can demonstrate that they have their own apartment. The centre-right cabinet of Prime Minister Mark Rutte motivated this measure with bottlenecks in the reception of asylum seekers.
Successfully sued
However, several refugees had successfully filed a lawsuit. Judges ruled that this measure was contrary to national law and international treaties. Now the government had asked for an injunction against these sentences. They should be suspended until the final decision of the Administrative Court on this dispute, probably in January. But the council refused.
