Countless bruises, a bleeding lip and torn pants – this is how a 56-year-old man treated his victim. He also threatened to infect the woman with AIDS. Suspect: “I don’t understand why she is complaining about me.”
It is an unusual confession that a 56-year-old makes before the Vienna court: there would only have been a dispute between him and the acquaintance of the suspect’s nephew. He then grabbed her, threw her on the bed and pulled down her pants out of “nervousness”.
Pants pulled down with no intention of rape
But nothing more would have happened. “When she lied, I grabbed her and pulled down my pants. I was angry, but then I did nothing.” But he denies the accused’s intentions of rape.The prosecutor’s legitimate question: “How could the victim have understood that you did not want intercourse if you took off her pants and underwear?”
Victim beaten black and blue
The photos taken by police after the April incident are shocking. The woman was black and blue: a black eye, multiple bruises all over her body, a swollen and bleeding lip. “He bit my bottom lip until I bled. He told me not to scream or fight back, it would be over sooner. I thought I wasn’t going to get out of this alive” – such her terrible statement.
According to the indictment, the 56-year-old punched the woman with his fists, forced her onto the bed and bit her lip. His little credible version: “We argued and then our mouths met and I bit her”
The suspect is HIV positive
In addition to the rape accusation, there is a second one: the spread of communicable diseases – a fact that is usually associated with Corona in the Vienna court. In this case, however, it concerns the diseases AIDS and hepatitis B. The suspect suffers from them.
“But do you know that what you did could cause others to get AIDS?” the judge admonished. But the 56-year-old does not want to know that he is ill – but takes medication anyway…
He would also have said to the victim: “I infect you with my disease.” That is why he gives a non-binding prison sentence of five years for both attempted rape and spreading infectious diseases.
