A 22-year-old man, who was paroled from prison last year, has been sentenced to 14 years in prison for raping a 16-year-old girl at the Vienna Regional Criminal Court.
The assaults took place on the night of January 1, 2023 at a private New Year’s Eve party in an apartment in Vienna-Simmering, where the 16-year-old was present with two friends. The later perpetrator also stayed there, who had recently been convicted of crimes against property and had been released early under certain conditions. The 16-year-old had never seen the 22-year-old. According to the first instance findings, he assaulted the 16-year-old when she was alone in a room with him. As the girl resisted, he threatened her with a deceptively real-looking gun by holding it to the victim’s temple. He then assaulted the victim handed over to him, using even more violence.
Apartment owner kicked in the door
The friends heard the 16-year-old crying and tried to help her. However, the 22-year-old blocked the locked room door. Finally, the owner of the apartment kicked in the door. The 22-year-old then ran off. He was arrested the next day at his address in Meidling with the support of WEGA. The alarm gun and various narcotics were seized.
Don’t confess
The suspect denied the rape allegations in court. He assured that he was not forcing the girl to have sex. However, a panel of judges gave credence to the representation of those affected.
No extenuating circumstances
The jury did not find any extenuating circumstances, so that for a sentence of up to 20 years, the court considered a prison sentence of 14 years appropriate for the guilt and the perpetrator. The 22-year-old did not agree, after which the public prosecutor appealed against the sentence.
