“Official secrecy!”: There is hardly another word that citizens hear more often when they ask the authorities for information. As a rule, it is quickly dismissed, because the term is generally of little use to the layman. Not everything is as secret as the authorities like to say, but some things are – and much of it is probably a matter of consideration. An attempt at an explanation.
The applicable official secrecy is laid down in the federal constitution; it is governed in particular by professional secrecy and the obligation to provide information (Article 20(3) and (4) B-VG). It applies generally to all local, state and federal authorities and their employees, and generally to everyone, even spouses. And that’s where the clarity largely ends – at least for the layman.
