Not legally binding – attempted murder: 14 years in prison for mother of four

After the closing arguments, the replay of the attempted murder trial against a mother of four at the Ried Regional Court turned into an hours-long nervous battle. After almost six hours of deliberation, the ruling this time was completely different from the ruling that had led to the replay. But it is not legally binding.

“Don’t make the same mistake as your predecessors,” said prosecutor Petra Stranzinger at the start of the replay of the attempted murder trial against Simona F. (32) at the Ried Regional Court. At the beginning of May, the jury’s first verdict, which was not for attempted murder but for grievous bodily harm, was suspended by the appeal judges ‘due to an error’.

Now the replay was running with different judges and judges. But the strategies remained the same: the prosecutor accused the Czech woman of running a cutting knife over her husband’s neck with the intention of killing him on August 2 of the previous year, leaving him with a gash of 18 centimeters inflicted. Emergency surgery saved the 40-year-old. Expert Adelheid Kastner testified that the mother of four had a “creative approach to the truth,” that she was a notorious liar and would sooner or later come into conflict with everyone she lived with.

The lawyers, Andreas Mauhart and Alexandra Schauer, rejected this version because the defendant named her eldest, then 13-year-old daughter, as the alleged perpetrator – as she did in the first trial.

Unanimous saying
The jury did not make it easy for themselves; a new test repetition is impossible. After six hours of deliberation, the unanimous verdict: 14 years in prison for attempted murder. The fact that the person was innocent and that it was an attempt was seen as a mitigating factor. What made it more difficult was the defenselessness of the victim and the close relationship with him. The Public Prosecution Service has announced an appeal because of the sentence, the defense has announced an appeal, so the verdict is not yet final. However, there is no repetition of the process; instead, the Higher Regional Court must decide the appeal.
