A 43-year-old man had to answer for the third time on Tuesday for persistently pursuing ex-girlfriends. While he received a suspended sentence in his two previous trials, this time there was no quarter.
On Tuesday, the Vienna Regional Court ruled for the third time in a short period of time against a 43-year-old man for stalking. While he got away with suspended sentences for the previous offenses, no leniency was shown this time. The notorious stalker was given a 10-month unconditional prison sentence and a three-month open prison sentence was revoked, meaning he will spend a total of 13 months in prison.
Judge Christoph Bauer justified the harsh sentence by saying that the convicted man had ignored all previous opportunities for improvement. “You have not yet taken advantage of all the opportunities that have been offered to you so far. “I can’t think of anything other than keeping you locked up longer,” the judge said. The verdict is already legally binding.
192 Tathandlungen
In June 2022, the suspect was already sentenced to a suspended sentence for persistently pursuing a woman via a dating app after ending a relationship. Despite this first conviction, the man continued his stalking practice, harassing another ex-girlfriend with phone calls, interceptions and uninvited visits. For this, he received another suspended sentence last year and was sentenced to undergo psychotherapy, which he did not comply with.
According to the indictment, between July and December 2023, the stalker committed exactly 192 acts that amounted to sustained persecution. This included leaving voice messages on voicemail, loitering outside the apartment and going to the 41-year-old woman’s workplace. As early as June 2022, the affected person had been temporarily banned from approaching the man.
Victims in psychotherapy
According to a complaint from the woman, the perpetrator was taken into custody between September 29 and October 30, but this did not impress him. After his release, he continued the stalking until he was taken back into custody on December 11. At that time, the troubled woman was already undergoing psychotherapeutic treatment.
“Emotional instability”
The affected 41-year-old, who entered the procedure as a private participant, received 1,000 euros in compensation from the court and reimbursement of the costs of previous therapy sessions. The suspect’s lawyer and the public prosecutor agreed with the verdict. In his defense, the stalker referred to his “emotional instability” and expressed his desire for inpatient therapy.
