Two boys aged 16 and 20 were sentenced to prison terms of six and ten months by the Vienna Regional Court on Thursday afternoon. Because of an alleged sex tape with an eleven-year-old, they severely beat a 16-year-old and threatened him with blank pistols.
The teenager and the young man in the Viennese countryside have already been convicted twice, both times for violent crimes. And in their third trial, they also face cruelty-laden charges. On May 29, the two Austrians – together with an accomplice – picked up a 16-year-old at a bank around Max-Winter-Park in Leopoldstadt.
Threatened with a “hole in the leg”.
Third, they dragged him with empty pistols to a nearby stairwell and then to the basement. “On the way to the stairs, one of the suspects already threatened the victim that he should not run away, otherwise he would get a hole in his leg,” the Public Prosecution Service accuses.
Why exactly did it hit the 16 year old? The moral watchdogs suspected that the victim was seen in a video showing an eleven-year-old girl having sexual intercourse with an older man. He has to admit that he was the one in the sex tape. “The suspect pressed the barrel of the gun against his neck and the other suspect pressed the gun against his ribs,” is how the prosecutor describes the brutal attack.
Despite protests of innocence, he was severely beaten
The teenager assured the boys, who were physically superior to him, that he was not the person in the video, pointing out that his beard looked different and that he had no scars on his upper body. But in vain: the three severely damaged the victim with fists and kicks: bruised ribs, shoulder injuries, muscle injuries, swelling, abrasions to the temples and an injury in the skull region. When he stopped moving, the perpetrators ran away with their victim’s cell phone.
The boys now made a full confession before a jury in Vienna. But they do not claim to have been the driving force behind the brutal attack. Instead, the third party in the alliance, which had already initiated proceedings over the incident, took the initiative. “You were persuaded to participate by the man who had already been convicted. Nowadays they also take responsibility for this,” explains lawyer Florian Kreiner, the 20-year-old’s lawyer. The accomplice received a six-month suspended prison sentence during his trial.
The teenager and the young man do not get off so lightly: the older one receives an unconditional additional sentence of ten months, his colleague receives a six-month prison sentence. The convictions for serious coercion and serious bodily harm are final. The two were acquitted of theft of mobile phones: “There is no intention to enrich themselves,” said lawyer Kreiner. They threw the phone into the bushes.
