The bureaucracy probably cannot ignore problems. Because the residential and commercial building of a family in Hagenbrunn, Lower Austria, was 60 cm too high, it was threatened with demolition 40 years later. This poses a threat to the owner’s existence. He wants to keep fighting.

Hagenbrunn is a quiet community on the northern edge of the Bisamberg, near the city limits of Vienna, a recreational paradise and a popular wine bar. The world still seems in order here. But not for everyone. Hannes and Sonja Wagner are confronted with the ruins of their existence. For two years they have been trembling in front of their house, where the homeowner’s ceramic factory is also located. Hannes Wagner produces clay vessels here based on age-old models, including urns.

About the history: When the building was built by his father in the 1980s, he was only seven years old. The father received a building permit from the municipality and subsequently a use permit for the completed building. Only much later did the house pass to his son.

Mayor refuses
So it has been in place for more than 40 years. A few years ago the family thoroughly renovated it. Suddenly it turned out that the object was 60 centimeters too high. Therefore, there is a risk of demolition. “We are stunned,” the couple said. According to section 70 of the Lower Austrian Building Act, the house could have been legalized through the mayor’s amnesty. But he didn’t want that.

The building authority’s rejection has now been heard in the second instance. The couple found out the complaint would not be honored during a dog walk in town, where a community board member was chatting.

Hannes and Sonja Wagner suspect intimidation by the mayor. It’s probably about something personal. “Due to the clear legal situation, we look forward to the further course of the procedure through the regional court,” the family says, but is combative.

Hagenbrunn’s mayor Michael Oberschil (ÖVP) responded to questions from “Krone”: “It is not about completely sanding the ‘Hüttn’. It’s not about total demolition. The courts will decide what happens. We must be on the side of the law. We don’t want to destroy anyone. But everything has to be fine.”
