Process after accidents – was hotelier carefree with his epilepsy?

Date:

A hotelier from the Tyrolean Unterland was accused of negligent physical damage. Was he treated his illness too carefree when he traveled by car? In any case, it crashed at least twice. The process now came to an end.

A collision in Pertisau, a spectacular fall in a ditch in book – do the now accused Tyrolean epileptic seizures, which then also led to injured? Already during the first head session, which took place in the Regional Court of Innsbruck in March, the man had held long and wide that he had taken the prescribed epilepsy medication correctly.

Apparently not pronounced awareness of illness
From time to time, the feeling was to say that the suspect did not really know if and to what extent he suffers from the disease. In any case, the process was postponed to obtain an expert opinion and continued on Wednesday.

The opinion of experts on tablet -intake
The expert report was given by the expert. According to blood level, it could be proven that the 63-year-old took his tablet at least in the morning, she explained. On the other hand, it was decided by a further intake of the second prescribed tablet later a day. However, she limited: “The accident may also have come in between.” Moreover, it must be stated that epileptic seizures can occur, even when taking both tablets. This statement was then also argued, with the right Mair, his ultimate acquittal. “A negligence is therefore no longer determined.”

“Stinks of Heaven” – but no negligence
Nevertheless, the “stinks of heaven” and the suspect should in the best case think of “no longer driving”, mainly because now with the knowledge that attacks can still occur when taking the tablets, negligence can probably come into play.

Authorities declared driving experience
At the moment, however, the suspect should not be accused: “He would, because the authorities explained to him and he realized all the investigations that he could ride,” said Mir. So negligence could not be determined without a doubt, he said. Mair, on the other hand, had fewer doubts about one thing: “They were actually epileptic seizures that led to the accidents.”
