“Close the gap” – Corruption criminal law: Greens increase pressure on ÖVP

After the Federal President’s warnings regarding the Schmid Causa, the ÖVP and the Greens are now negotiating more intensively about tightening the criminal law on corruption. Justice Minister Alma Zadic (Greens) has specified one point in the draft submitted to the ÖVP more than a year ago, Greens club president Sigrid Maurer confirmed on Friday. It increases the pressure on the coalition partner.

“I am not aware of any argument from the coalition partner why we should not immediately close this loophole. Taking the Federal President’s words seriously also means that this point of the government program must be completed after party funding and the Media Transparency Act,” Maurer emphasized in a statement. Further talks are now planned with the Minister of Constitutional Affairs Karoline Edtstadler (ÖVP) – with the involvement of the club bosses.

Gaps in the law since Ibiza clear
The amendment aims to close criminal justice gaps in the field of corruption that have been exposed in the course of the Ibiza affair. The cornerstones are an expanded criminal liability for the purchase of mandates and the expansion of the notion of public officials in bribery. It should also be a criminal offense for a politician to promise a particular service in exchange for money or other benefits before holding the corresponding position of a “public servant” — that is, in an election campaign, the “Kurier” and “Wiener Zeitung” reported.

In principle, support for individual election campaigns should not be banned. What equates to “good manners” should remain permitted. This was made clear with the current clarification – at the request of the ÖVP, in which preferential election campaigns usually play an important role.

Serious consequences for reactivation
Due to an incident in prison, Zadic initially issued a decree for her department to settle the issue of the legal consequences of Nazi crimes. Even before the law is changed – in response to the sensational case in the army – she has ensured that cases of re-employment in the civil service are punished more severely.

In the future, the judiciary will always argue for dismissal in the civil service procedure if a bailiff has been convicted under the Prohibition Act, the Salzburger Nachrichten reports. The case in question was a Lower Austrian prison officer who was convicted of relevant chats but is still on duty because the disciplinary authority did not demand release.
