The Social Forum points out that in all these experiences it has verified that “the right of victims is a fundamental human right that does not prescribe”. For this reason, on the eve of December 10, International Human Rights Day, he assured that “the right to the truth is a fundamental part of the rehabilitation of victims of human rights violations; while this is a core requirement, both victims of ETA must and the state, we must verify the enormous difficulties of accessing the truth,” he adds.

This group points out that “from the perspective of all victims, regardless of the agent violating their human rights, sharing the truth, seeking it out and acknowledging it gives them dignity and can be a step towards rebuilding their lives .” “In the case of the victims of the state, these violations are possible because of institutional silence, because the statute of limitations on complaints and the refusal to acknowledge the abuse protects the perpetrators and confers impunity,” he criticized.

It also points out that governments “are not always willing to recognize or guarantee the right to the truth to the victims of the state, and sometimes they choose a superficial search, to comply, but as an additional obligation.” It also states that “file policy (official secrets law) prevents access” to documents, and there is no mechanism for transitional justice.

Despite progress being made recently, he emphasizes that international experience shows that conditions must be met for the establishment of a truth commission, such as that there is “a societal demand, not only from the victims, but also of other collectives”. ; financial, technical and intellectual resources enabling its development; political will, “not just to support a commission, but the will of the actors under investigation, to bring to light the acts committed”; and an assurance that “the area in which the commission will operate is sufficiently pacified”.

In any case, the Social Forum recognizes that a Truth Commission for the Basque cause “is not currently gathering the necessary consensus, either institutionally or politically”, but affirms that it “must not lead to acquiescence and the victims in their struggle for this right” .

According to him, “a civil society-led initiative is a tool to promote social truth and expert truth, making it possible to demand official recognition and redress and improve or support institution-initiated truth-seeking projects”.
