As reported, Governor Doskozil wanted to undo the mandatory instead of voluntary on-call time and the Medical Association scheme in Burgenland. The country sees itself confirmed in substance, but the complaint was rejected for formal reasons.
The Constitutional Court (VfGH) rejected the state’s appeal on the issue of the appeal of doctors over the weekend. The services are currently voluntary and regulated by the Medical Association.
Taking care of the public interest
Governor Hans Peter Doskozil wants to change that. For the state, ensuring on-call time is in the public interest and should therefore no longer be regulated by the chamber alone.
formal reasons
According to the head of the staff department of the Constitutional Service, Florian Philapitsch, the rejection was only for formal reasons. In substance, the Constitutional Court largely agreed with the state.
