A 21-year-old father from the district of Tulln (Lower Austria) was on trial for negligent bodily harm. He allegedly dropped his one-month-old son while changing diapers. The child suffered a skull fracture. Another time, the Mostviertler broke both of the child’s legs while dressing. The 21-year-old has since been sentenced to a suspended prison sentence and a fine.
Fractures of the tibia and fibula, skull fracture with cerebral hemorrhage – according to expert opinion, the little baby will have to struggle with the consequences of the injuries for the rest of his life. This tragic case leaves even a hardened judge baffled. Because when asked whether the 21-year-old father should have been left alone with the child at all, he answered unequivocally with “No!”
The young Mostviertler himself is severely disabled: according to the defense, the incidents are due to the serious visual impairment of the suspect. “It was not on purpose, I am terribly sorry about all this,” the father confessed guilty at the beginning of the trial.
He was “overwhelmed” by the situation. In November last year, the 21-year-old allegedly broke both his son’s legs when he put on tights. Just a few days later, the baby fell off the changing table while changing diapers. The mother heard a loud “pumping” in the next room, but could not identify the sound. The baby suffered a basilar skull fracture. The next day, the father was arrested.
“No Average Parents”
The young couple – the 20-year-old mother also suffers from a disability – had asked for support for the time after giving birth. Unfortunately, this came too late: the boy will have to deal with the consequences for the rest of his life. It is clear that these are “not your average parents”, the judge believes that the authorities are acting too slowly. “But you could have asked your family for help yourself,” Mr. Rat says to the father. The case against the mother has now been dropped.

“What happened should not be repeated under any circumstances,” the prosecutor concluded. The 21-year-old was eventually sentenced to eight months in prison and a fine. He must also pay the victim 11,400 euros in damages and be liable for all future damages related to his son’s injuries. In addition, the young man must take parental or educational guidance to “be trained in baby handling”. The baby is currently in youth care and will end up with a foster family in the future.
