Although the woman suffered a stroke, she was not taken away by emergency services until they called again. A long legal dispute ensued…
On 23 January 2013, an ambulance was sent to the complainant at around 02:00. The paramedics did not take the woman away. She was only admitted to Innsbruck University Hospital after another emergency call at 8:21 am. Diagnosis: stroke.
The verdict was overturned
The patient demanded compensation for pain and suffering, and the first court upheld the lawsuit. After a long legal battle, the Supreme Court overturned this ruling. Although the emergency services culpably failed to transport the stroke patient to the hospital in time, there is still no liability for consequential damage.
It could not be determined whether the therapy that could have led to a cure would have been carried out if the patient had been brought in in time. Especially since this can also be fatal.
