Ukrainian accused: rape or “bruises from hugging”?

Two Ukrainians allegedly posed as tourists and brutally raped a young Viennese woman in a hotel room. The 37-year-old director, who is now in court, cannot explain these accusations at all. Especially since his friend got intimate with the woman – and he’s stuck in Ukraine and can’t come to the trial.

It is a case of statement against statement – as is so often the case in the Vienna Regional Court. And as is often the case, the stakes are high: the 37-year-old in the dock is accused of rape. In mid-January 2022, the Ukrainian and an old friend allegedly posed as tourists in Vienna, spoke to a woman and took her to the hotel room – where they allegedly attacked her together.

“Bruises from having sex”
The young woman later said this to the police. In fact, there is no objective evidence whatsoever in the proceedings – even the public prosecutor has to admit that. Only hematomas in the intimate area and neck could be found. Lawyer Klaus Ainedter can explain the latter: “It has been proven that the bruises are not the result of a physical altercation, but from hugging.”

The second defendant is in custody in Ukraine
Because his client admits that his friend, with whom he was on a business trip in Vienna, had consensual sex with the victim. The second defendant cannot appear for his trial himself. He lives in Ukraine and is currently not allowed to leave the country.

The 37-year-old, who has been working in Germany as director of a construction company since February 2022, must sit alone in front of the jury. He knew nothing about such a rape. He slept in the hotel room and his friend had sex with the woman.

Almost exclusively the victim’s statement remains as evidence for the prosecution. However, lawyer Klaus Ainedter has serious doubts about this, and he has even sought expert advice about inconsistencies in her statement. “The witness corrected her information more than once. “She has already changed it several times with the police,” the lawyer questions the credibility.

The chairman wants to know from the 37-year-old why the young woman should falsely accuse the two Ukrainians: “The question is not fair. I cannot look into the minds of others.” Because the man detained in Ukraine is needed as a witness in any case, a video interview is postponed.
