In a letter available for the “Süddeutsche Zeitung”, the Ministry of Culture explains that Lisa Poeter’s “activity and membership” in extremist organizations are not compatible with the requirements for a teacher. Her dedication to brown coal mine and participation in protests against the International Automotive exhibition in Munich (IAA) has been particularly criticized.

“Not compatible with the democratic basic order”
Poetinger was a member of the “Open Anti -Agitalist climate meeting Munich”, which is recognized as a legal organization. “Profit maximization” is a “sentence that must be assigned to the conditions of communist ideology,” the ministry said in its reasoning. This is not compatible with the free democratic basic order.

Activist defends himself with reference to the Constitution
Poeter himself sees injustice in this assessment. “I am Marxist, but at the same time an advocate of the basic law and the Bavarian Constitution,” she emphasizes. It was always important for her to stand up for democracy and the basic law, even if she rejects capitalism. “As a result, a rejection of capitalism must at least be possible in part in respect for the basic law,” she says.

In her own argument, she refers to the Federal Constitutional Court, which in the past stated that the basic law does not determine an immediate determination of a certain economic order.

Ministry of fear calling for political quote
However, the Ministry of Culture makes it clear that the political explanations of Poetinger and its activism are a danger to trust in public administration. In particular, the slogan “system change does not interpret climate change”, which Poetinger used during their protests, the ministry as a call for the political quote. “This slogan can not only be conceived as a call for climate neutrality,” the ministry said, “but as a call for a fundamental system change.”

Moreover, there are currently various studies underway against Poetinger. A procedure refers to protests against coal extraction in the North Rhine-Westfalian Lützerath, in which Poeter is said to have resisted enforcement officials and that is also emphasized. Another procedure concerns the destruction of AFD election posters, in which Poetinger had publicly explained that she had “withdrew” because she did not want to accept “inhumane ideologies”.

Decision is practically a job ban
The decision not to allow Poeter to become a legal internship means practically a vacancy for you. Without the legal internship she could not find a job at private schools. She herself is against this decision and claims that her political attitude and activism would be in accordance with the values ​​of the basic law.

“I see it as my duty to protect our means of existence. A sense of responsibility for nature and the environment is also one of the best educational destinations of Bavaria, “Poeter said recently in a statement. However, the Ministry of Culture sees no excuse for its presumably illegal actions and emphasizes that there is no tolerance for politically motivated legal breaks.

Decision is reminiscent of the 1970s
This case raises questions that go much further than the individual case. Because the assessment of public service applicants was an explosive subject for their constitutional loyalty, especially in the 1970s and eighties, especially with regard to political left -wing activities. The thus -driven radical decree of 1972 meant that countless teachers in the Federal Republic of Germany were excluded due to political beliefs of the status of the civil servant.

This practice was continued in Bavaria until 1991. It was recently discussed again whether such assessments should be carried out again with a view to the increasing extremism of the judge.

Activist wants to defend himself
The case of Lisa Poetinger shows that it is still possible to influence the political attitude of public service applicants in individual cases. Poetinger still has the opportunity to sue this decision, what she will probably do. In any case, this case could again ignite the discussion about political beliefs and its compatibility with a career of the civil servant in Germany.
