The political groups will present their amendments to the reform of the penal code this Friday. In turn, ERC proposes to distinguish between people who personally benefit from embezzlement and those who do not.

The Socialist Group and Unidas Podemos have tabled an amendment to the bill reforming the Penal Code introducing a new criminal offense for punishable by up to three years in prison to government officials whose assets increase by more than 250,000 euros without being able to justify this.

This amendment proposes that public authorities be obliged to do so justify that enrichment for five years after leaving their responsibility.

To this end, they have tabled an amendment to the bill they promoted with Unidas Podemos to end, among other things, the crime of sedition, as explained at a press conference by the spokesman of the Socialist Group in Congress. Patxi Lopez.

ERC proposal

This is the reaction of the implementing parties to the reform of the crime of embezzlement promoted by ERCwhich proposes to differentiate between sanctions in cases where there is no intention to profit or use public funds for one’s own benefit.

As currently drafted, the crime of embezzlement makes no distinction between people who personally benefit from crime and those who do notand imposes penalties of two to six years’ imprisonment for those who commit this offence.

López has insisted that the PSOE amendment has nothing to do with the crime of embezzlement that ERC is proposing to retouch while processing this initiative.

The Socialist leader has also assured that they have not negotiated with the Republicans on this issue and I have emphasized that the PSOE, like the Penal Code itself, “distinguishes” between “corruption and embezzlement”.
